Draft Regional General Permit and ILF Prospectus

BCAG and the Permit Applicants are pursuing a Regional General Permit (RGP) from the U.S. Army Corps of Engineers (Corps) from all BRCP Covered Activities that result in discharge of fill material into waters of the U.S and are subject to Section 404 of the Clean Water Act (CWA). The draft RGP below would allow a streamlined permitting process for public and private projects that result in wetland impacts up to 1.5 acres or 400 linear feet of stream bank. 

BCAG is also pursuing the establishment of an In-Lieu-Fee Program (ILF Program) that would cover the BRCP Plan Area and provide compensatory mitigation for activities authorized by Section 404 of the CWA within the BRCP Plan Area. These documents were made available for a 30-day public review period as required by the Corps which closed on December 14, 2015. BCAG and the Permit Applicants will seek approval of a final RGP and ILF Program within 6-12 months of BRCP approval.
